miss your mother country so much and plan to go home after a long time of living and working here as an overstaying foreigner? well, this is the things you should know when you want to personally surrender at the immigration.

you can apply for "DEPORTATION PROGRAM" of japanese government if you,
(1)voluntarily surrender on the immigration office
(2)illegaly overstaying here in japan
(3)have no criminal records or alike done here in japan
(4)have no records of overstaying here in japan

the following are the things you should know when you will surrender if you are over staying here in japan. this is the story when i assisted one of my friend when she surrender at the tokyo immigration office.
(1)go to the immigration main office personally. i prefer the regional immigration office and not the immigration branch office nearest you. if you cannot speak japanese that much, i preferred that you must go there with someone who can speak japanese language enough.

(2)in the immigration office, try to go to information desk to ask for "SYUTTOU SHINKOKU", they will guide you and tell the section that handle it.

(3)at that section, you will assisted by personnel and give you some forms that you must fill-up. fill-up the form and fall in line and wait for your turn. this will be your first interview. at first interview, they will ask you some details how you get here? why you are voluntarily surrendering and your present documents that you have.

(4)the documents that you need to make your release or flight to go back in the philippines much more early is only passport and flight ticket. if there is no problem about your passport and it is still valid, they will only request you to prepare for flight ticket. but if your passport is already invalid, you will be requested to go to philippine embassy or consulate to get travel affidavit. you must go back again to the immigration after you get your travel affidavit at the date they assigned to you.

(5)go to the philippine embassy or consulate to get a travel affidavit. they will give you schedule when you can get it. then go back again to get it.

(6)after getting your travel affidavit, go back again to the immigration office where you voluntarily surrender at the date they assigned to you. they will check your travil affidavit and give you a go signal to buy your plane ticket. this is the time where you can buy a ticket. dont buy or pay for it unless not told by the immigration personnel. your processing may takes time sometime so there is possibility that you cannot go back at the date you reserved. this will be your second interview. the immigration personnel will give you another schedule when to go back after you buy your plane ticket.

(7)go back again to the immigration office at the date they assigned to you with the plane ticket or the receipt of it. proving that you have make your reservation. this will be your last interview. after the interview, they will give you the date of your flight to go back on your homeland. this time, all processing of your papers are completed.

(8)go to the airport where your flight is. there is nothing to worry on the aiport and in the immigration section. you just submit the papers given to you at the immigration. dont get nervous, be calm like your flight when you get here in japan.

one point reminders:
(1)make sure that you can go back to the immigration office at the date they assigned to you. if there is a reason that you cannot do it, call the immigration and look for the personnel assigned to you and tell them that you cannot be on that date.

(2)at the immigration office within the section where you will surrender, there are lots of personnels who came from airline ticket office and other legal consultants offices that will assist you, but after that they will try to make you buy a ticket from them. never make a reservation or make a downpaymnet for your ticket as long as there is no go signal to buy it from immigration personnel. you cannot refund any amount you deposit on any personnel doing business there.

(3)the penalty for those who voluntarily surrender will be a 1 year suspension to travel again here in japan.

                      may i ask lang po kung kung mahuhuli po  b ang isang o.s. ofcourse ddlin cla agad dun sa imigration ano po b ang dapat iprepare pra mkauwiagad sa pnas? mag bbyad po ng penalty or money ung nag sponsors sa kanya? mag kno nman  po?

PENALTY PAG NAHULI ANG ISANG NAG OVERSTAY
Base sa bagong revised law about overstaying, ang PENALTY na babayaran ay tinaas mula sa 300,000 to 3,000,000 YEN (30 LAPAD ay naging 300 LAPAD na). Ito ay di lamang sa mga overstayer na nahuli, sakop din dito ang mga gumamit ng mga pekeng PASSPORT, or yong mga passport na ginamit ng isang tao ay di nila tunay na pangalan ang nakasulat na nakapasok at naninirahan na here sa Japan.

Sa panahon naman na kakailanganin para muling makabalik here sa Japan ay ang mga sumusunod:
(1) Kung ang isang nag overstay ay NAHULI AT MERON NANG RECORD BEFORE na nahuli rin sya at pinabalik sa pinas, 10 YEARS ang parusa na ibibigay. after ng 10 years, pwede na ulit syang magapply ng visa para makapunta ulit here sa japan.

(3) Kung ang isang nag overstay ay NAHULI AT WALA PANG RECORD BEFORE na nahuli rin sya, 5 YEARS ang magiging parusa. after 5 years, pwede na ulit syang mag apply ng visa para makapasok ulit here sa Japan.

(2) Kung ang isang nag overstay ay KUSANG LOOB NA SUMUKO sa immigration, 1 YEA lang ang parusa. after 1 year, pwede na ulit syang mag apply ng visa para makapasok ulit here sa Japan.


ANO DAPAT GAWIN KAPAG GUSTONG SUMUKO
Ang mga sumusunod po ay kinakailangan upang ang isang nag overstay na kusang loob na sumuko ay madaling makauwi or makabalik sa pinas. Magiging madali ang proseso ng pagpapauwi sa isang overstay na sumuko kung ang lahat ng ito ay masusunod.

(1) Ang pag suko ng isang overstay ay bukas sa kanyang kalooban at kusang pumunta sa immigration office.
(2) Walang ibang kaso maliban sa pagiging overstayer na magiging dahilan para sya ay pauwiin.
(3) Walang anumang police record or anumang kasalanang ginawa na labag sa batas ng Japan.
(4) Walang record na sya ay nahuli na before bilang isang overstay.
(5) Kumpleto or hawak pa nya ang mga kinakailangang travel document tulad ng passport.

The last time na sinamahan kong sumuko sa tokyo immigration yong isang nag overstay before na nagpasama sa akin, ang naging problem lang nya is yong passport nya. lagpas na po yong validity ng passport nya kaya kinailangan pa nyang pumunta sa Philippine Consulate para kumuha ng TRAVEL AFFIDAVIT. Di po passport ang inapply nya kundi TRAVEL AFFIDAVIT lang po. Since first time nyang mag overstay at wala rin syang POLICE RECORD here sa Japan, naging maayos yong procedure at naging madali po. Ininterview lang sya ng sumuko sya, then another interview po ng pinabalik sya wherein complete na yong papers nya like the TRAVEL AFFIDAVIT at PLANE TICKET po. Sya pa mismo mo ang pinapili kung kelan nya gusto umuwi or lumipad pabalik ng pinas. Ginawa siguro nila ito para lubos na makapag handa yong nag overstay. Tulad ng paghanda nya para sa pambili ng plane ticket po.


PARUSA SA NAG SPONSOR SA ISANG NAG OVERSTAY
As of now po, sa mga nababasa kong mga information related to this matter, wala akong nakikitang law na may kaukulang penalty rin ang isang nagsponsor sa isang nag overstay. Sa homepage ng immigration here sa Japan at sa mga homepages ng ilang attorney association here sa Japan po, wala akong makitang information about this matter. Maybe wala nga siguro, pero I'm not 100% sure.

Ang alam ko lang is kapag tumalon or nag overstay ang isang tao, yong nag sponsor sa kanya ay mahihirapang mag sponsor ulit ng isang tao. As long na di sumusuko or nahuhuli yong ini-sponsor nyang nag overstay, mahihirapan syang mag invite here ulit. Isa pa raw po, kapag yong nag sponsor ay di pa PERMANENT here at nagrernew lang ng VISA, bago aprobahan daw yong VISA application nya, kinakausap daw po sya ng immigration personnel regarding don sa ini-sponsor nya na tumalon. So medyo may kakulitan sila with regards to this matter. Kaya hanggat di sumusuko or nahuhuli yong nag overstay, yong nag-sponsor talaga ang mananagot at kokontakin ng immigration. Kaya napaka important po talaga yong GUARANTEE LETTER kapag mag aapply ka ng visa.

fyi lang po. . .

   ako po ay sumurrender na last nov.19 first time ko lang nag overstay at totoong pangalan ang ginamit ko sa passport ko so binigyan ako ng 1 yr. penalty at pwede na akong bumalik ulit dito sa Japan.

   Ang gusto ko lang ipaalam ay yun friend kong kasama ko rin sumuko dahil may discrepancy yun passport nya yun b-day sa passport nya at yun b-day sa birth certificate ay magkaiba ang ibinigay na penalty sa kanya ay 5 yrs, ganon na pala ngayon kahit suko ka ay pwede kang bigyan ng 5 yrs penalty basta may error yun passport.

Ang one year penalty ay binibigay lamang sa mga nag overstay wherein ang kasalanan lang talaga nila is pagiging overstayer. Kung may kasalanan pa sila bukod dito, madadagdagan yon base sa bigat ng kasalanan na ginawa nila.

Since sa iyo is OS lang talaga ang naging kaso mo at the time na sumuko ka, 1 year lang talaga ang bibigay sa iyong penalty base don sa batas nila about it. Now about your friend, it is not just a matter of discrepancy sa birth date nya. Di na sya paniniwalaan kahit sabihin nya na nagkamali lang sya ng sulat sa passport application or sa birth certificate nya. They will identify it as FALSIFICATION OF DOCUMENT already, which is a big case. Kaya ang nangyari sa friend mo is naging 2 ang kaso nya. OS at saka FALSIFICATION OF DOCUMENT. Sa pagiging OS nya is 1 year, then siguro sa pamemeke ng dokumento ay 4 na taon ang binigay, kaya all in all is 5 years.

Kung matatandaan natin, sa lahat ng application na sinusulatan natin, meron laging part kung saan tayo nagsasign. Sa baba or taas noon, laging may nakasulat about sa katotohanan ng mga data na nilagay mo. na kapag mali ang nakasulat don eh pananagutan mo. Kaya magiingat po tayo at dapat natin laging i-double check ang mga data na nilalagay natin bago mag-sign. Kung meron di naintindihan sa mga application form, dapat magtanong para makasigurado tayo.

Striver san ask ko lang po,kagaya ng kaso ko. Tnt ako at nagpakasal pagtapos nun pumunta kami ng immigration nun dec 2007 para ipasok yun kasal namin at the same time pagsuko na din kasi pina-thumb mark nila ako at kinunan ng picture. At ininterview kami mag-asawa. Pagtapos nun sabi sa amin wait na lang daw kami sulat o tawag. Tapos nun pinatawag kami for interview nun may 2008 yun kasunod june 2008 na at di na ako pinalabas pa. Ang tanong ko lang po,anu po ang kalalabasan ng kaso ko? Voluntary bang masasabi ang pagsuko ko? Confused lang po ako pasensya na sa kakulitan. Tnx again and more power. icon_salute

sorry at ngayon ko lang nakita yong tanong na ito. late na ang reply ko. medyo mahirap sagutin ang tanong mo. pero i think kung nong pumunta kayo sa immigration at dumiretso kayo sa section or window kung saan pina-process yong mga voluntarily na sumuko, it will be registered as voluntarily kasi magkakaroon ka ng record sa section na yon. pero kung dumiretso ka sa visa application window dahil nga nagpakasal kayo ng mister mo, siguro di nila ika-count na voluntarily kang sumuko or meron kang willingness na sumuko at that time. kaya di ka na nila pinalabas before.

last two years ng may sinamahan akong sumuko voluntarily sa immigration, direct kami don sa section ng mga sumusuko. then di sya kinulong or hinuli. pinauwi sya freely at binigyan pa ng 2 months para makaipon ng pera pamasahe pauwi.  wave1

hi po,good day!
first tym ko po dito at gusto ko po sana magtanong about my case?
overstay po ako dito sa japan,about 2years have a baby,ngayon year lang po kmi nagpakasal ng aking asawa at tatay ng baby ko.gusto ko po sana magtanong kung paano po ba sumurender at mag apply po ng visa here sa japan po?
